HB 3749 Moves Out of Committee After Significant Changes to Language and Public Hearing

The public hearing for Texas HB 3749 occurred on Monday, April 28 and AmSpa founder and CEO Alex Thiersch, JD, personally attended, along with Alexis Gordon, MD, FACS, Chair of AmSpa’s Texas State Chapter.

Texas HB 3749 as it was originally introduced would have severely restricted the ability of NPs and PAs to treat patients in medical aesthetic facilities, potentially leading to worse patient outcomes in legally compliant practices. 

The final version approved by the committee is much narrower in scope and now includes language keeping the scope of practice of NPs and PAs in line with other areas of medicine. Language including “cosmetic medical treatments” and “medical spas” has been removed, restricting the bill to solely “elective intravenous therapy.” Additionally, the bill now specifically retains the ability of physicians to delegate “prescribing, or ordering elective intravenous therapy” to nurse practitioners or physician assistants with a proper prescriptive authority agreement. As well, the bill no longer requires direct, on-site physician supervision, instead relying on proper supervision definitions already outlined in Texas law for NPs, PAs and RNs.

A new addition to the bill is the restriction of administering IV treatments to persons with a license of RN or above.
