Plastic surgeon used woman's photos without permission, suit says

A Franklin Lakes plastic surgeon used photographs of a patient in advertisements without her permission, according to a complaint filed in June in Bergen County Superior Court.
Jennifer Peeples, of Passaic, received various treatments, including Smart Lipo Triplex liposuction, at Dr. Park Avenue in Franklin Lakes in April 2014 and 2015.
Peeples posed for "before and after" pictures and was told they were for her chart. After the treatments, Dr. Park Avenue asked for Peeples' consent to use the photos for advertisement, which she denied repeatedly, the complaint said.
The complaint accuses Dr. Park Avenue and the owner of the business, Dr. Paul Fondacaro, of invasion of privacy, violating the Health Insurance Portability and Accountability Act (HIPAA), fraud, breach of contract and infliction of emotional distress
Peeples, who is represented by the Epstein Law Firm of Rochelle Park, asked for a jury trial.
A woman who answered the phone at Dr. Park Avenue said the office had no comment.
