Texas Governor Greg Abbott signed Texas HB 3749 into law on Friday, June 20, 2025.
Jenifer’s Law went through a series of changes on its way through the legislation. Originally filed in March 2025, it contained provisions for physician supervision in medical spas that would have dramatically restricted the roles of advanced practitioners, limiting their ability to provide needed oversight that protects patient safety in medical spas.
AmSpa and the medical aesthetic community spoke up to advocate for safe practices and educate legislators about the roles of nurse practitioners (NPs) and physician assistants (PAs) in legally compliant med spas. The bill’s sponsors thoughtfully considered public input and testimony from industry stakeholders, passing a substituted bill through the Committee on Public Health that eliminated the medical spa provisions and clarified the supervision and delegation of elective IV therapy. The Texas House of Representatives and Senate passed this version and sent it to the Governor on May 27.
Under the new law, elective IV therapy is defined as a procedure sought by a patient to administer fluids, nutrients, medications, or blood directly into a patient's bloodstream through a vein to alleviate symptoms of temporary discomfort or improve temporary wellness; and that is administered outside of outside of a physician’s office or a licensed healthcare facility.
Who can prescribe an IV? A physician can delegate to a physician assistant or advanced practice registered nurse the authority to prescribe an IV therapy treatment.
Who can administer an IV? Administration of elective IV therapy can be delegated from a physician to a physician assistant, an advanced practice registered nurse or a registered nurse under adequate supervision.
The law goes into effect September 1, 2025.
