ARIZONA Bill Would Regulate Medical Spas

AmSpa’s Take: There has been a growing national trend to regulate and license medical spas and aesthetic practices. This year alone several states have introduced similar legislation. 

Analysis: Currently in Arizona, as in most states, medical spas are regulated the same as other medical practices. If passed, HB 4047 would create licensing and practice requirements for medical spas.

Under HB 4047 a medical spa is defined to mean a facility or practice that offers medical or cosmetic health care services. Facilities or practices required to hold a different state license are exempt from this definition. If passed, HB 4047 would require that all medical spas that handle, dispense, store or administer prescription medication apply for a registration as a medical spa. Failure to register can result in fines or being prohibited to do business in Arizona. Medical spas are required to report all serious adverse events to the pharmacy board. The board is empowered to inspect medical spas and investigate violations. The information for registered medical spas would be included in a public database listing at least the name, address and license number of the medical spa and the name and license number of the designated responsible person. 

As part of obtaining a registration, every medical spa must denote a “responsible person.” A responsible person is a licensed healthcare provider who has supervisory authority at the medical spa. Under the current language, a responsible person must be physically present on site for enough time to ensure that the medical spa is complying with the requirements of this bill. Board approval may be needed for a responsible person to oversee more than one location. 

HB 4047 designates all medical spas as dispensers under the federal Food Drug & Cosmetic Act. Each medical spa would also be required to store all prescription medications in a safe and clean environment with appropriate supervision and security features. Medical spas would also only be able to purchase medications from licensed and authorized entities. 

HB 4047 would also make it a violation of the Arizona’s Deceptive and Unfair Trade Practices Act to make misrepresentations about prescription medication. These include representations as to the medication’s:

  • Quality, grade, or particular standard;
  • Sponsorship, approval, characteristics, ingredients, uses, or benefits;
  • A function similar to a drug approved by the Food and Drug Administration (FDA); or
  • Approval from the FDA.

Of note, very similar bills have been introduced in Indiana, Iowa, and Florida. However, the language of this bill makes it apply to almost all healthcare practices, even if they don’t consider themselves medical spas. This is because a practice only needs to provide medical or cosmetic health care services and administer or dispense prescription medication to be required to register as a medical spa.
