NEW JERSEY Bill Would Create Laser Tattoo Removal Certificates

AmSpa’s Take: Some states have introduced bills that create limited or specialty licenses for certain cosmetic procedures such as laser hair removal. Often these bills can face significant opposition and as a result, many bills of this type can become stuck in committee and fail to pass.

Analysis: Currently, in New Jersey, as in most states, laser tattoo removal is regulated as a medical procedure. New Jersey does not have a recognized certification that would allow someone who is not a licensed health professional to perform this procedure. If passed, S 1572 would create a laser tattoo removal treatment certification.

S 1572 would allow people not licensed as physicians to become certified to offer laser tattoo removal services. The certification would be issued by the Board of Medical Examiners. The exact qualifications and requirements for the certification are not set out in the bill. Instead, the board and the Department of Health are directed to develop rules and regulations for this certification. At a minimum these rules must address the qualifications for the person, development of a certification test, and continuing education requirements. The certifications would need to be renewed every 2 years and only physicians would be able to offer laser tattoo removal without being certified. 

Occasionally states will adopt licenses or certifications for single procedures such as laser hair removal, microneedling, or laser tattoo removal. However, this is not a very common or strong trend nationwide.
