NEW YORK Bill to Allow Estheticians to Microneedle

AmSpa’s Take: The addition of microneedling treatments to cosmetologist and esthetician scopes of practice is a common trend across multiple states. 

Analysis: Currently, New York treats microneedling as a type of acupuncture treatment to be performed by licensed acupuncturists. Typically, estheticians and cosmetologists are prohibited from performing services on their own that invade or affect the living tissue. A 3084 seeks to expand the scope of practice of cosmetologists and estheticians to include microneedling, which, in this case, refers to FDA-approved devices that use needles no longer than 0.3 mm. Devices that have needles longer than that are not included. 

In order for estheticians and cosmetologists to add this service to their scopes of practice, they would need to complete an OSHA blood-borne pathogen training and a board-approved 40-hour course. The course includes instruction on:

  • Anatomy and physiology of the skin;
  • Safety and infection control practices and universal precautions;
  • Proper handling, sanitizing, disinfecting and disposing of materials that come into contact with blood or bodily fluids; and
  • Client assessment and identification of contraindications.

As cosmetic medical procedures become more common and popular, there has been a strong trend to expand the practice of estheticians and cosmetologists to include these services. This is most commonly done by creating new advanced practice licenses with different training requirements.
