Facebook Postings Showing Misuse of FMLA Leave Can Form Sufficient Basis for Termination of Employee

According to a Federal District Court in Michigan, a hospital that recently fired a nurse/employee while she was on medical leave did not violate the Family and Medical Leave Act (FMLA) because the nurse has posted photos about her Mexican vacation activities on Facebook,which were contrary to her medical restrictions, and then lied about the activities.   In this digital age, employers and co-workers have increased access to employees personal and social lives outside of work through Facebook, Twitter, LinkedIn, and other social media platforms.  Thus, employees must take extra precaution when sharing personal and private information in public settings to avoid unintended consequences in the workplace.
