Tennessee Medical Spas Have New Registration Requirements

Since January 1, 2016, medical spas in Tennessee have been required to register with the Board of Medical Examiners as required by Tennessee Code § 63-6-105 . The Board has recently adopted rules adding some additional requirements to this registration process. The new rule is known as 0880-02-.24 and can be reviewed on page 89 of the General Rules and Regulations Governing the Practice of Medicine .  
Under the new rules medical spas will need to register before opening or within 60 days of the rule becoming effective which is December 28, 2018. In order to register, medical spas will need to provide the Board with a complete Application for Registration of a Medical Spa along with the registration fee of $175. Registration must be renewed every 12 months with a new application and fee. 
It is the medical director or supervising physician’s responsibility to ensure that the medical spa complies with the registration, signage, and advertisement requirements as required in Tennessee Code § 63-1-153  and the new rule. Physicians and medical directors are subject to discipline for unprofessional conduct for services provided at a medical spa that is operating without a current registration. The medical director or supervising physician of the medical spa will need to provide their name, license number, and primary practice location along with the application. Additionally, the supervising physician or medical director will need to attest to their acceptance of responsibility for the services provided by the medical spa. And the medical director will need to comply with the certification information called for in sections (b) and (c) of § 63-1-153.
